Recipients of personal data

As part of our business activities, we work together with various external bodies. In some cases, this also requires the transfer of personal data to these external bodies. We only pass on personal data to external parties if this is necessary in order to fulfill a contract, if we are legally obliged to do so (e.g. passing on data to tax authorities), if we have a legitimate interest in the disclosure in accordance with Art. 6 (1) point f GDPR or if another legal basis allows the data transfer. When using processors, we only pass on our customers' personal data on the basis of a valid contract for order processing. In the case of joint processing, a contract for joint processing is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent that you have already given at any time. The legality of the data processing carried out up to the point of revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 GDPR)

IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6 PARA. 1 LIT. E OR F OF THE GDPR, YOU HAVE THE RIGHT TO OBJECT, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA, THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS FOR PROCESSING IS PROVIDED IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN PROVE THAT THERE ARE COMPELLING REASONS FOR PROCESSING WHICH ARE WORTHY OF PROTECTION AND OUTWEIGH YOUR INTERESTS, RIGHTS AND FREEDOMS, OR IF THE PROCESSING SERVES THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 PARA. 1 DSGVO).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21 SECT. 2 GDPR).

Right to lodge a complaint with a supervisory authority

In the event of violations of the GDPR, data subjects are entitled to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged violation. The right to lodge a complaint exists regardless of any other administrative or judicial remedies.

Right to data portability

You have the right to have data which we process based on your consent or in fulfillment of a contract automatically delivered to yourself or to a third party in a standard, machine-readable format. If you require the direct transfer of data to another responsible party, this will only be done to the extent technically feasible.

Information, correction and deletion

Within the scope of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if necessary, a right to correction or deletion of this data. You can contact us at any time regarding this and other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time regarding this. The right to restriction of processing applies in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is carried out unlawfully, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have objected to processing pursuant to Article 21(1) GDPR, your rights and our rights will have to be weighed against each other. As long as it has not been determined whose interests prevail, you have the right to demand a restriction of the processing of your personal data.

If you have restricted the processing of your personal data, these data – apart from their storage – may be processed only with your consent or for the purpose of asserting, exercising or defending legal claims or protecting the rights of another natural or legal person or on grounds of an important public interest of the European Union or a Member State.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and for the protection of the transmission of confidential content, such as the inquiries you send to us as the site operator. You can recognize an encrypted connection in your browser's address line when it changes from “http://” to “https://” and the lock icon is displayed in your browser's address bar.

If SSL or TLS encryption is activated, the data you transfer to us cannot be read by third parties.

Objection to advertising e-mails

We hereby object to the use of contact data published in accordance with the imprint obligation to send unsolicited advertising and information material. The site operators expressly reserve the right to take legal action in the event of unsolicited advertising information being sent, for example by spam e-mails.

4. data collection on this website

Cookies

Our websites use so-called “cookies”. Cookies are small data packages and do not cause any damage to your end device. They are either stored temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted after the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or until they are automatically deleted by your web browser.

Cookies may come from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary because certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies may be used to evaluate user behavior or for advertising purposes.

Cookies that are required for the performance of electronic communication processes, for the provision of certain functions you want to use (e.g. for the shopping cart function) or those that are necessary for the optimization of the website (e.g. cookies that provide measurable insights into the web audience) (necessary cookies) shall be stored on the basis of Art. 6 Sect. 1 lit. f GDPR, unless a different legal basis is cited. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, the processing is carried out exclusively on the basis of this consent (Art. 6 sec. 1 lit. a GDPR and § 25 sec. 1 TDDDG); the consent can be revoked at any time.

You can set your browser so that you are informed when cookies are set and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If you deactivate cookies, the functionality of this website may be limited.

This data protection declaration explains which cookies and services are used on this website.

Server log files

The website provider automatically collects and stores information that your browser automatically transmits to us in “server log files”. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

These data will not be combined with data from other sources.

This data is recorded on the basis of Art. 6 Sect. 1 lit. f GDPR. The website operator has a legitimate interest in the technically error free depiction and the optimization of the operator's website.

Inquiries via email, telephone, fax or contact form

If you contact us by email, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We will not share this information without your consent.

The processing of these data is based on Art. 6 para. 1 lit. b DSGVO, provided that your request is related to the execution of a contract or is required for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6 para. 1 lit. f DSGVO) or on your consent (Art. 6 para. 1 lit. a DSGVO), provided that this has been requested; the consent is revocable at any time.

The data you send to us via contact requests will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have finished processing your request). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

5. analysis tools and advertising

Matomo

This website uses the open-source web analysis service Matomo.

With the help of Matomo, we are able to collect and analyze data about how visitors use our website. This enables us, among other things, to find out when which pages were viewed and from which region they come. In addition, we collect various log files (e.g. IP address, referrer, browser and operating systems used) and can measure whether our website visitors perform certain actions (e.g. clicks, purchases, etc.).

This analysis tool is used on the basis of Art. 6 Sect. 1 lit. f GDPR. The website operator has a legitimate interest in the analysis of user patterns to optimize both, the services offered online and the operator's advertising activities. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TDDDG. The consent can be revoked at any time.

We use IP anonymization when analyzing with Matomo. This means that your IP address is shortened before the analysis so that it can no longer be clearly assigned to you.

We have configured Matomo so that it does not store any cookies in your browser.

Contract data processing

We have concluded a contract for order processing (AVV) for the use of the above-mentioned service. This is a contract prescribed by data protection law that ensures that the personal data of our website visitors is only processed in accordance with our instructions and in compliance with the GDPR.

6. Plugins and tools

YouTube with advanced data protection

This website embeds videos from the website YouTube. The website operator is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of these websites on which YouTube is embedded, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

We use YouTube in advanced privacy mode. According to YouTube, videos played in advanced privacy mode are not used to personalize your browsing on YouTube. Advertisements displayed in enhanced data protection mode are also not personalized. No cookies are set in enhanced data protection mode. Instead, however, so-called local storage elements are stored in the user's browser, which, similar to cookies, contain personal data and can be used for recognition. Details on enhanced data protection mode can be found here: https://support.google.com/youtube/answer/171780.

It is possible that further data processing operations may be triggered after a YouTube video has been activated, over which we have no influence.

YouTube is used in the interest of presenting our online offers in an appealing way. This constitutes a legitimate interest within the meaning of Art. 6 (1) point f GDPR. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 (1) point a GDPR and Art. 25 (1) TDDDG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TDDDG. The consent can be revoked at any time.

Further information about data protection at YouTube can be found in the company's data privacy policy at: https://policies.google.com/privacy?hl=de.

The company is certified according to the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the United States to ensure compliance with European data protection standards for data processing in the United States. Every company certified under the DPF is obliged to comply with these data protection standards. Further information can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

7. e-commerce and payment providers

Processing customer and contract data

We collect, process and use personal customer and contract data for the purpose of establishing, defining the content of and making changes to our contractual relationships. We collect, process and use personal data concerning the use of this website (usage data) only to the extent necessary to enable the user to access our service or to bill the user. The legal basis for this is Art. 6 (1) (b) GDPR.

The collected customer data shall be deleted after completion of the order or termination of the business relationship and expiration of any existing legal retention periods. Legal retention periods remain unaffected.

Data processing by social networks

We maintain publicly accessible profiles on social networks. The individual social networks we use can be found below.

Social networks such as Facebook, X etc. can generally analyze your user behavior comprehensively if you visit their website or a website with integrated social media content (e.g. like buttons or banner ads). When you visit our social media pages, numerous data protection-related processing operations are triggered. Specifically:

If you are logged into your social media account and visit our social media page, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, this data collection is done, for example, by cookies that are stored on your device or by recording your IP address.

The data collected in this way allows the operators of the social media portals to create user profiles in which your preferences and interests are stored. This way, interest-based advertising can be displayed to you both within and outside of the respective social media presence. If you have an account with the respective social network, the interest-based advertising can be displayed on all devices on which you are or were logged in.

Please also note that we are not able to retrace all processing operations on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. For details, please refer to the terms of use and data protection provisions of the respective social media portals.

Legal basis

Our social media sites are designed to ensure the widest possible presence on the internet. This is a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO. The analysis processes initiated by the social networks may be based on different legal bases, which are to be indicated by the operators of the social networks (e.g. consent within the meaning of Art. 6 para. 1 lit. a DSGVO).

Controller and assertion of rights

If you visit one of our social media sites (e.g. Facebook), we, together with the operator of the social media platform, are responsible for the data processing operations triggered during this visit. You can, in principle, assert your rights (information, correction, deletion, restriction of processing, data portability and complaint) both against us and against the operator of the respective social media portal (e.g. against Facebook).

Please note that despite our joint responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are largely determined by the corporate policy of the respective provider.

Storage duration

The data collected directly by us via the social media presence will be deleted from our systems as soon as you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory provisions – in particular, retention periods – remain unaffected.

We have no influence on the storage duration of your data that is stored by the operators of social networks for their own purposes. For details, please contact the social network operators directly (e.g. in their data protection declaration, see below).

Your rights

You have the right to receive information about the origin, recipients and purpose of your stored personal data at any time and free of charge. You also have the right to object, to data portability and to lodge a complaint with the relevant supervisory authority. Furthermore, you can request the correction, blocking, deletion and, under certain circumstances, the restriction of the processing of your personal data.

9. Our own services

Handling of applicant data

We offer you the opportunity to apply for a job with us (e.g. by email, post or via an online application form). The following information is provided to you about the scope, purpose and use of your personal data collected during the application process. We assure you that the collection, processing and use of your data is carried out in accordance with the applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG) under German law (initiation of an employment relationship), Article 6 (1) (b) GDPR (general contract initiation) and – if you have given your consent – Article 6 (1) (a) GDPR. Consent can be withdrawn at any time. Within our company, your personal data will only be shared with individuals who are involved in processing your application.

If your application is successful, the data you have submitted will be stored in our data processing systems on the basis of Section 26 of the German Federal Data Protection Act (BDSG) and Art. 6 (1) point b GDPR for the purpose of implementing the employment relationship.

Data retention period

If we are unable to offer you a job, if you reject a job offer or withdraw your application, we reserve the right to store the data you have provided on the basis of our legitimate interests (Art. 6 (1) (f) GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). After that, the data will be deleted and the physical application documents destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the six-month period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if legal storage obligations prevent deletion.

As at: 12/2024
